Update on California ADA Litigation Reform

Since 2005, 16,530 lawsuits concerning Americans with Disabilities Act (ADA) violations were filed in federal courts. And more of these abusive lawsuits were filed in California than any other state across the country. 

The latest California legislation (SB 1186) — which became effective January 1, 2013, intended to provide protection for owners and operators of public facilities who make good faith efforts to comply with the ADA provisions.

But it has proven to be only marginally successful, with experienced attorneys working within boundaries to circumvent the new law.

Still though, many businesses wanted SB 1186 to go farther than written, proposing restrictions on litigation until after a defendant had reasonable time to correct alleged violations, and thereby limiting abusive construction defect  litigation.
